Article 1: General provisions

The e-commerce website of Petit Patsy, a sole proprietorship with registered office at Rumbeeksesteenweg 379, 8800 Roeselare, VAT BE0643461871, RPR Kortrijk, (hereinafter 'Petit Patsy') offers its customers the opportunity to purchase products from its web shop online.


These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website ("Customer"). Placing an order via the Petit Patsy web shop implies that the Customer has consulted these Terms and Conditions and expressly accepts the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by Petit Patsy.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties that the Customer is obliged to pay.

If delivery, reservation or administrative costs are charged, this will be stated separately.
The price quoted refers exclusively to the articles as literally described. The accompanying photos are for decorative purposes and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Petit Patsy. Petit Patsy is only bound to a means obligation with regard to the correctness and completeness of the information provided. Petit Patsy is in no case liable in the event of material errors, typographical errors or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Petit Patsy. Petit Patsy cannot be held liable for the unavailability of a product.

Article 4: Online purchases

The Customer can place one or more items in his shopping cart on the webshop, after which the Customer can check and confirm all selected items. After confirmation, the Customer is redirected to the payment page where the Customer can complete his order. After payment, the order is confirmed.


The Customer can choose between the following payment methods:

· by bank transfer to account number BE26737041902629

The Products offered through this e-commerce website constitute an offer that is subject to the condition of acceptance by Petit Patsy.

Petit Patsy is entitled to refuse an order (in writing) as a result of a serious shortcoming on the part of the Customer with regard to the order or any other order or agreement in which the Customer is involved.

Article 5(a): Delivery and performance of the agreement

Items ordered through this webshop will be delivered within Europe.

Delivery is made by standard courier services, the costs of which depend on the country of delivery.

Unless otherwise agreed, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order.

Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported immediately to Petit Patsy by the Customer.

The risk of loss or damage shall pass to the Customer when he (or a third party designated by him, other than the carrier) has taken physical possession of the goods. However, the risk shall pass to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Petit Patsy.

Article 6: Retention of title

The delivered items remain the exclusive property of Petit Patsy until full payment has been made by the Customer.

The Customer undertakes to inform third parties of Petit Patsy's retention of title if necessary, e.g. anyone who might seize items that have not yet been fully paid for.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase articles online from Petit Patsy in their capacity as consumers.

The Customer has the right to cancel the agreement within a period of 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day:

on which the Customer or a third party designated by the Customer, other than the carrier, acquires physical possession of the goods or on which the Customer or a third party designated by the Customer, other than the carrier, acquires physical possession of the last good.

To exercise the right of withdrawal, the Customer must contact Petit Patsy, Rumbeeksesteenweg 379, 8800 Roeselare, info@petitpatys.be, by means of an unequivocal statement (e.g. a letter sent by post or e-mail) of his decision to withdraw from the contract. The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to Petit Patsy, Rumbeeksesteenweg 379, 8800 Roeselare, info@petitpatys.be without delay, but in any event no later than 14 calendar days after the day on which he communicated his decision to cancel the agreement to Petit Patsy. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned product has been diminished in value in any way, Petit Patsy reserves the right to hold the Customer liable and claim damages for any diminished value of the goods resulting from the Customer's handling of the goods that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories, instructions and invoice or proof of purchase can be returned.

If the Customer revokes the agreement, Petit Patsy will refund all payments received from the Customer up to that point, including the cost of standard delivery costs, to the Customer within a maximum of 14 calendar days after Petit Patsy has been informed of the Customer's decision to revoke the agreement. In the case of sales agreements, Petit Patsy may wait with the refund until it has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever is the earliest.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by Petit Patsy will not be reimbursed.

Petit Patsy will reimburse the Customer using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any fees as a result of such reimbursement.

The Customer may not exercise the right of withdrawal for the delivery of goods manufactured according to the Customer's specifications or which are clearly intended for a specific person.

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of purchase by (or delivery to) the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to retain the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must first contact Petit Patsy customer service, after which the Customer must return the item to Petit Patsy at his own expense.

If a defect is discovered, the Customer must inform Petit Patsy as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. After that, any right to repair or replacement will lapse.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Nor does it apply to articles with a shorter lifespan or wear and tear articles.

Defects that manifest themselves after a period of 6 months following the date of purchase or, if applicable, delivery, shall be deemed not to be hidden defects, unless the Customer provides proof to the contrary.

The warranty is not transferable.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to Petit Patsy, in the event of non-payment or late payment, the Customer shall owe, by operation of law and without notice, an interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall owe, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Petit Patsy reserves the right to take back items that have not been (fully) paid for.

Article 11: Privacy

The controller, Petit Patsy, respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes: execution of the concluded agreement, processing the order and sending newsletters.

You have a legal right to inspect and possibly correct your personal data. Provided proof of identity (copy of identity card) you can obtain written notification of your personal data free of charge via a written, dated and signed request to Petit Patsy, Rumbeeksesteenweg 379, 8800 Roeselare, info@petitpatsy.be. If necessary, you can also request to correct data that is incorrect, incomplete or irrelevant.

We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties.
The customer is responsible for keeping his login details confidential and using his password. Your password is stored in encrypted form, so Petit Patsy has no access to your password.

Petit Patsy keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

Article 12: Use of cookies

Article 13: Affectation of validity - non-waiver

If any provision of these Terms is held to be invalid, illegal or void, this will in no way affect the validity, legality and enforceability of the other provisions.

The failure at any time by Petit Patsy to enforce any of the rights stated in these Terms and Conditions or to exercise any right hereunder shall never be deemed to be a waiver of such provision and shall never affect the validity of these rights.

Article 14: Changes to conditions

These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of Petit Patsy. In the event of any conflict, these Conditions shall prevail.

Petit Patsy may change these Terms at any time without notice. Any purchase after the change implies acceptance by the Customer of these new Terms.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

Article 16: Applicable law - Competent court

Belgian law applies, with the exception of the provisions of private international law regarding applicable law and with the exception of the Rome I regulation regarding international sales contracts for movable property. In the event of any disputes, only the courts of Kortrijk have jurisdiction.

Article 17: UNIZO e-commerce label

Kortrijk has endorsed the UNIZO e-commerce label Regulations. A copy of these Regulations and access to the UNIZO complaints procedure is available via www.unizo.be/e-commerce .
